1.) Consideration to Approve Ordinance 2020-32, an Ordinance Approving the 802 Empire Avenue Subdivision, Located at 802 Empire Avenue, Park City, Utah

Thank you for allowing me to weigh-in on this matter. I represent Rick Kienzle, who lives adjacent to the proposed 802 Empire Subdivision. I provided you with a letter earlier today regarding Mr. Kienzle’s concerns related to the designation of the potential future public stairway. While I will not belabor the points I raised in the letter once again here, I do want to underscore Mr. Kienzle’s hope that you will take some time to investigate and designate the location of the future possible location of the public stairs, should the City decide to construct them at some point in the future.
Mr. Kienzle equally hopes that you will recognize the proactive steps that Mr. Peek and Mr. Kienzle have taken by coming together in good faith and designating a logical and sensible location for the public stairway, should the City decide to construct the stairway in the future. Mr. Peek’s and Mr. Kienzle’s intent is to avoid potential future disputes between the two neighbors, future property owners, and more significantly, disputes and lawsuits between the property owners and the City, if and when the stairs are constructed. Of course, Mr. Peek’s and Mr. Kienzle’s agreement has little to no effect unless the City also participates in these discussions and elects a location.
Please note that Mr. Kienzle is not proposing that the City construct the stairways now, or even at all. Rather, Mr. Kienzle is requesting that the City recognize and appreciate the steps that are being taken to avoid future problems and lawsuits, and that the City join these efforts and exercise its planning powers to solidify the location now, as part of the current proposal. Again, the hope is that a little bit of effort and decision making now will prevent substantial disputes down the road.
