My name is Nick Frost and I represent Rick Kienzle who lives at 808 Empire Avenue. I provided you with a public comment letter earlier today regarding the Public Stairs. I am writing again to clarify that Mr. Kienzle recognizes and understands that the Planning Commission does not have the ability to designate and authorize a final location of the future public stairs. However, it is entirely within the purview of the Planning Commission to recognize and discuss the issue, as well as to provide a recommendation to the City Council that the location of the public stairway be discussed in more depth at the City Council level. As I stated in the letter, neighbors have met together in good faith and are attempting to work with the City with the objective of resolving the issue and avoiding future problems down the road. It is Mr. Kienzle’s hope that the Planning Commission will recognize the significance of these events and take some time to ensure that any approval provided by the Planning Commission will include a recommendation or suggestion that the City Council continue to review the location of stairway in connection with the approval of Mr. Peek’s plat.
