4.B) Land Management Code Amendments - The Planning Commission Will Conduct a Work Session on Fractional Ownership of Single-Family Dwellings in Residential Zoning Districts. PL-22-05210. (60 min.)
We are both long term residents of The Aerie subdivision and even longer term in Park City itself, having both moved here in the 70s'. Like others we have seen many changes to our town and are striving to maintain what sense of community we have left in our neighborhoods. We do not believe that time share, or fractional ownership uses are compatible with primary resident neighborhoods. Therefore, we strongly encourage the change to the LMC to prohibit fractional ownership in primarily residential Zoning Districts. Of course, we would also like to see The Aerie included in the General Plan map of primarily residential Zoning Districts, it seems this map is based on 2010 data and may be outdated.
On a related issue, The Aerie is zoned residential and nightly rentals are prohibited. There is currently a home on the corner of Mellow Mountain Rd. and Eagle Way that is listed on VRBO for nightly rental - https://www.vrbo.com/379307. This matter was brought to the attention of code enforcement at Park City Municipal back in October of 2021, however it appears to still be used as nightly rental. Perhaps we could also do a better job of enforcing our current regulations.
I am a full time resident in the Aerie subdivision. I would recommend including Aerie as a primary residential neighborhood and I support restrictions on residential timeshares including fractional ownership within park city and residential neighborhoods.
1) I support the City’s efforts to restrict residential timeshares via Pacaso and other LLC’s.
2) This is a National issue. For more details, see the website StopPacasonow.com. City’s such as Palm Springs, Santa Barbara, Napa Valley and Sonoma have already implemented City/County wide restrictive ordinances. Please review their documents on this website.
3) I urge the City to be as restrictive as possible. So far, residential timeshares have been focused on higher end resort homes. But, Pacaso’s CEO has stated their next growth area is lower priced residential homes. Park City could potentially have 100’s of these timeshares.
We strongly endorse the proposed amendment to the Land Management Code and would request a clarification that Aerie is included in the primarily residential Zoning District. Aerie is zoned single family and nightly rentals and timeshares are prohibited. Permitting further spread of fractional ownership to our neighborhood will create incompatible uses. Fractional ownership requires short stay/high turnover more akin to nightly rentals and timeshares, uses that are prohibited in Aerie. Permitting fractional ownership will permanently and negatively impact the current single family usage in Aerie and other similar neighborhoods.

My family owns a home on Aerie Drive and also a not-yet-built lot. We strongly support limiting fractional ownership programs to areas that are already commercial or, more specifically, banning them from primarily residential areas such as Aerie. One fear we have is that fractional ownership may result in substantially more noise due to parties and the like and adversely impact the character of our community.
In addition, we believe that Aerie should be included in the group of primarily residential zones as that is certainly an apt description of Aerie.
